User Responsibility & Content Ownership

By submitting any content to Amapha, users represent and warrant that they either own the content or have obtained all necessary rights, licenses, permissions, and authorizations required to publish and distribute such content on the platform.

Users are solely responsible for ensuring that the content they upload does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party. This includes, but is not limited to, copyrighted photographs, professionally written property descriptions, marketing materials, and any other protected works.

By uploading content to Amapha, users grant Amapha a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute such content solely for the purpose of operating, promoting, and improving the platform’s real estate services.

Amapha does not claim ownership of User Content. However, we reserve the right to remove, restrict access to, or disable any content that we reasonably believe may infringe intellectual property rights or violate applicable laws or our platform policies.

Users who repeatedly submit infringing content may be subject to account suspension or termination at Amapha’s sole discretion.

Submitting a Copyright Infringement Notice (Takedown Procedure)

If you believe that content available on Amapha infringes your copyright or the copyright of a party you are authorized to represent, you may submit a written notice requesting removal of the allegedly infringing material.

To ensure prompt processing, your notice must include the following information:

  • You have obtained proper authorization or license from the original copyright owner.
  • The claim filed against your listing is inaccurate or misleading.

Submitting a counter-notification is a serious legal declaration. You should only proceed if you are confident in your rights to the content.

What Your Counter-Notification Must Include

To ensure a proper review, your counter-notification must contain:

  1. Your full legal name and contact information (email address and phone number).
  2. Identification of the content that was removed, including the specific listing URL (if available).
  3. A clear statement explaining why you believe the removal was made in error.
  4. A declaration, made in good faith, that you believe the content was removed as a result of mistake or misidentification.
  5. A statement affirming that you consent to the jurisdiction of the appropriate court within Nigeria, where applicable.
  6. Your physical or electronic signature.

Incomplete submissions may delay the review process.

Review and Reinstatement Process

Once a valid counter-notification is received:

  • Amapha will review the submission for completeness and credibility.
  • The original complainant may be notified of the counter-notification.
  • If no further legal action is initiated within a reasonable period, the content may be reinstated at Amapha’s discretion.

  • There is a pattern of uploading content that does not belong to them.
  • The user ignores prior warnings or compliance notices from Amapha.

Amapha evaluates each case carefully to distinguish between honest mistakes and deliberate misuse.

Monitoring and Enforcement

Amapha reserves the right to monitor content submissions and enforce its policies at its sole discretion. Users found to intentionally misuse the platform for unauthorized content distribution may lose access without prior notice.

Where necessary, Amapha may cooperate with relevant authorities in Nigeria to address serious or repeated violations.

Commitment to Platform Integrity

By maintaining a strict repeat infringer policy, Amapha ensures:

Amapha operates as an online platform that enables users to independently create and publish property listings. We do not pre-screen, pre-approve, or actively monitor all user-submitted content prior to publication. As such, Amapha functions as an intermediary service provider and does not assume ownership or editorial control over User Content.

No Direct Liability for User Content

Amapha shall not be held liable for:

  • Copyright infringements committed by users
  • Unauthorized use of third-party materials uploaded by users
  • Inaccurate ownership claims made within listings
  • Any damages resulting from reliance on user-submitted content

Responsibility for ensuring lawful use of content rests entirely with the user who uploads it.

Good Faith Removal of Content

Amapha reserves the right to remove or disable access to content alleged to infringe intellectual property rights upon receiving a valid complaint. Such actions are taken in good faith to protect rights holders, maintain platform integrity, and comply with applicable laws in Nigeria.

Removal of content does not constitute an admission of wrongdoing by Amapha.

Safe Harbor Position

To the fullest extent permitted under applicable law, Amapha seeks to operate in accordance with recognized intermediary liability principles, including notice-and-takedown frameworks. We act promptly upon receiving proper notification of alleged infringement and provide a counter-notification process to ensure fairness.

Our role is limited to facilitating listings between property owners, agents, and interested parties. We are not the creator, publisher, or guarantor of user-generated content.

Limitation of Damages

To the extent permitted by law, Amapha shall not be liable for indirect, incidental, consequential, or punitive damages arising from:
